Free For All Friday...



I came across the following article a little while ago and thought it was well worth sharing...




The national school walkout for gun control that took place at many public schools across the country Wednesday likely violated the Constitution.

That is because the government — in this case, public schools — made a special accommodation for a political viewpoint that it would not make for the opposing view, or for any other view.
A long history of First Amendment jurisprudence establishes that such viewpoint discrimination is impermissible.
The way to put schools on the hot seat would be to organize a pro-Second Amendment walkout, or a walkout on various other issues.
Pro-life organizations could organize a national student walkout on behalf of unborn children, for example, and dare school districts to provide equal support and funding to that which they provided for the national anti-gun walkout. (That ought to make next year’s March for Life, usually held in January, even more interesting.)
School districts could argue that they were not discriminating among viewpoints, but rather expressing their own viewpoint. That it unlikely to pass constitutional muster, either, because schools are not supposed to be advocating for certain public policy issues, not to mention taking a position that arguably undermines a provision of the U.S. Constitution.
But it would require the school districts to argue that the walkout was not “student-staged” at all. It would expose the fact that the walkout was largely run by national political organizations like Women’s March and lobbyist groups like the PTA.
In any lawsuit, moreover, many school districts would likely have to face the fact that their participation in the anti-gun walkout violated their own policies. That is not even a constitutional issue, but a basic administrative law issue. It is the basis for a potential lawsuit by angry Connecticut parents against the New Milford Board of Education, for example.
What happened Wednesday was wrong, and no amount of Democrat-media cheerleading can change that.

    Jose Inez Garcia-Zarate, the illegal alien acquitted last year of murdering 32-year-old Kate Steinle in July 2015, has sued the federal government, demanding that it produce documents “pertaining to vindictive prosecution and collusion” with the state government in its prosecution against him.
    In November, a San Francisco jury found Garcia-Zarate not guilty of murdering Steinle, agreeing that although he had the gun from which the fatal shot was fired, the discharge could have been accidental.

    The jury did convict Garcia-Zarate of felony possession of a weapon. He had seven previous felony convictions and had been deported five times before finding “sanctuary” on the streets of San Francisco, a noted “sanctuary city.”

    The federal government immediately issued a warrant for Garcia-Zarate’s arrest for violating the terms of his 2015 federal prison release. It then charged him with federal crimes — “for being a felon in possession of a firearm and ammunition, and for being an illegally present alien in possession of a firearm and ammunition.”

    As reported by CourthouseNews.com, Garcia-Zarate is alleging “that federal agencies colluded with the San Francisco police, district attorney’s office and sheriff’s office” and that he is being subjected to double jeopardy — being tried for the same crime twice.

    In the motion, filed Tuesday, Garcia-Zarate’s attorney complains: “Almost immediately after the death of Ms. Steinle, then presidential candidate Donald Trump began to use Mr. Garcia-Zarate as the symbol of the dangers of illegal immigrants and the need for a wall between the United States and Mexico.” The attorney also cites several tweets by President Donald Trump as proof that his client is being subjected to unfair treatment.

    The federal charges that follows, the attorney argues, violate Garcia-Zarate’s rights to due process: “Though broken up into two counts, these allegations address the exact same conduct as that for which he was convicted in San Francisco.”

    To prove his case of “vindictive prosecution” and collusion between state and federal law enforcement, Garcia-Zarate is demanding all records of communication between federal, state, and local law enforcement about the case.

    Ironically, California is currently battling the federal government over state laws that restrict cooperation and communication between state and local government with federal immigration officials.

  5. If not having a weapon is a condition of his parole, it most certainly isn't double jeopardy. Parole violators can go straight to jail, they don't get a trial, just a hearing.

  8. My, my, my. Criminals suing for "malicious prosecution". What in the wide wide world of sports is going on in this country.

    Maybe we should sue California for "inept prosecution". They blew a case that a second year law student could have won. They put a dangerous murderous felon back on the streets. The allowed a murderer to walk free, and now he's suing them. That just beats all.

    And why the hell does this guy have any right to sue anybody? He's an illegal alien. Deported five times and seven felony convictions. He shouldn't even be in this country, let alone filing frivolous law suits draining taxpayer dollars.

    This one event is probably as good an example of the insanity that has gripped the godless left in this country. If you had to pick one single thing that demonstrates the hatred for America these people have, this would be it.

    These people have lost their collective minds. I could list a hundred examples that prove it. Maybe it's time for those black helicopters and reeducation camps. Maybe it's time for another Alien and Sedition act like John Adams passed. Lock these bastards up. Maybe like Lincoln did. Suspend Habeas Corpus during a time of war. Cause we sure as hell are at war. And until America wakes up and realizes it, we will slowly lose our country to these evil satanic maniacs.

Also broadcasting that she was the lead defender of a bunch calling themselves the "dream 9". These clowns got deported by ICE but she managed to get them all back into the country.
    What I wouldn't give to see ICE grab her and deport her.

  12. Below is a statement made about the bridge building company that had a bridge collapse in Florida yesterday. Sounds kind of like a bunch of illegals?

    Miami-based Munilla Construction Management, which reportedly took on the bridge contract, was accused in a lawsuit from earlier this month of hiring "incompetent, inexperienced, unskilled or careless employees."

  20. Just saw the movie I Can Only Imagine. We never go to movies because they’re all trash. But this one....I can’t say enough. It’s only here a short time so you should see it. Best movie I’ve seen in years. Careful though, lots of dust in there. My eyes kept watering up.

Just incredible how they try to spin all of this....Trump fired McCabe to threaten Mueller, Trump told Sessions to fire McCabe or he would be next...etc.
    Then there is Farakan, whom the Liberals have not problem buddying up to in spite of all of his Racist, Anti-Semantic views and talk! Just what would happen if this was a conservative talking up about the KKK or the so-called White Extremeist, using the exact same words as Farakan?

  38. McCabe going to get his retirement, some jackass Rep from Wisconsin is going to hire him on at a federal job, so he will get his FERS. All he needs is a few days as they use his highest 3 years to determine benefits ans since he was a FBI employee he will get a bigger multiplier for determining benefits. There is no justice for these folks, not until the next revolution.

  41. NPR of all people has a story about Pro Publica retracting its report of Gina Hespel's involvement in waterboarding...she did not participate or oversee it. Just more democrat shenanigans to reshape facts into narrative to push their agenda.
    Personally I don't view waterboarding as torture anyhow...if it were, we certainly would not put our own servicemen through it as part of their survival training.

  44. Drama in the neighborhood last night.

    People across the street had a St. Patrick's Day party. Nothing unusual about that. They have one every year.

    But last night they had that one guy (that used to be me) that had way too much to drink and decided he wanted to fight everyone there. (also used to be me) The party spilled out into their front yard. The out of control guy got a hold of a gas can and threw gas all over my neighbors yard and set it on fire.

    I went outside while Linda called the fire department.

    They showed up along with three cops.

    Fire was put out.

    Drunk guy was hand cuffed and hauled off to jail. (also used to be my job)

    It's been over twenty years since I quit drinking so I hardly ever think about it.

    But last night was a good reminder of why I quit in the first place.

  45. I have been shopping at Dillon's Aka Kroger's for about 30 years, This week I am going in to tell all the service personnel that are Friends for years good by, Apple or Hi-Vee here I and my Grandson come. Kroger's just lost $400 to $500 dollars a month.

    One of the largest supermarket chains in the country is reportedly telling magazine distributors they will not carry a list of popular gun magazines moving forward.

    Jim Shepherd with The Outdoor Wire reports that 57 specific publications are targeted for removal from Kroger’s racks with titles ranging from Guns & Ammo, and Firearm News, to Recoil and S.W.A.T. Shepherd points out that the move could be a nail in the coffin to already sluggish print sales for gun magazines.

    I think I work more now that I am officially retired, but the work is much more fun and rewarding. I have an African violet show and sell starting in a couple weeks and I am grooming over 30 plants to enter in the show for judging. It can be very stressful. The Dallas African Violet Society clubs are considered the best growers in the country. We need to keep up our high standards. If I don't win a best in class it is like a slap to my face. First place for me just doesn't make it. I just hope I can keep my violets in perfect blooming form until the show starts on the 23rd. That is a long time to keep a plant in bloom.
